Recently, Beijing Sunshine Intellectual Property International Co., Ltd. and Beijing Yiju Law Firm jointly represented Suzhou Pineapple Health Technology Co., Ltd., in an administrative lawsuit for patent invalidation. In Civil Judgment No. 15241 [2020], First, Civil Division, 73, Beijing Intellectual Property Court returned a verdict that denied case 44359, where the patent with filing number 201830409294.2 was invalidated. Consequently, Hyperice’s “Hypervolt” massage gun design patents were all invalidated.

During the process of gathering evidence, our attorneys found video evidence of staff massaging NBA star LeBron James’s knee with a massage gun, and argued that said video constituted publication according to patent law. Beijing Intellectual Property Court ultimately accepted the argument of our attorneys, and denied Hyperice’s claim.
