Recently, Xu Bin and Ningbo Roaby Group, jointly represented by San Yangguang and Beijing Yiju Law Firm, successfully concluded the final trial of the dispute over infringement of invention patent rights between Hebei Yideli Rubber Supply Company and Hebei Jitong Company.

The Supreme People’s Court made Civil Judgement No. 1696 [2020]:

1.Civil Judgement No. 284 [2019] ruled by Shijiazhuang Intermediate People's Court is formally reversed.

2.Hebei Yideli Rubber Supply LLC immediately ceases production and distribution of patent No. 200410049491.5, which refers to Xu Bin’s patented product “Expansion joint apparatus for ultra large yield resisting comb type bridge”.

3.Hebei Yideli Rubber Supply LLC pays 2,975,000 Yuan in compensatory damages, and 25,000 Yuan in reasonable costs of patent protection, to Xu Bin and Ningbo Roaby Group within 10 days of the day of ruling.

The product involved in this case patent No. 200410049491.5, the name of “Expansion joint apparatus for ultra large yield resisting comb type bridge” previously won the China Patent Awards, and was commonly used in major construction projects such as Hangzhou Bay Cross-Sea Bridge and the Hong Kong-Zhuhai-Macau Bridge.
