Recently, a patent invalidation proceeding jointly handled by Beijing Sunshine Intellectual Property International Co., Ltd. and Beijing Sunshine IP Law Firm was concluded.
Hebei Gellec New Energy Science & Technology Joint Stock Co., Ltd. withdrew its invalidation request against Patent No. 201380061102.8, titled "Separator for Non-Aqueous Secondary Battery and Non-Aqueous Secondary Battery", owned by Shanghai Energy New Materials Technology Co., Ltd. (a subsidiary of Yunnan Energy New Material Co., Ltd.).
This patent, together with another patent, is involved in a RMB 210 million patent infringement dispute between Semcorp and Gellec. In Invalidation Decision No. 567709 previously issued by the China National Intellectual Property Administration (CNIPA), the aforementioned patent was upheld as valid. This invalidation proceeding represented another challenge by Gellec.
